Dcphosting Services is proud to offer an exceptional level of performance, reliability, and service. We make this commitment to our customers in the form of a Hosting Agreement which provides certain rights and remedies regarding the performance of Dcphosting Services's websites. Dcphosting Services's Hosting Agreement guarantees our reliability and performance. This Hosting Agreement applies to all customers of Dcphosting Services.

15-Day Money Back Guarantee:
Dcphosting Services will refund to Client any money paid for site hosting and/or "pre-installation and pre-configuration" within the first 15 days of service. This does not include money paid for customization for which the client has approved. Apply Here

39-Day Site Change Guarantee:
Dcphosting Services realizes that a Client may not like their first choice of a "pre-installed and pre-configured" package. Therefore Dcphosting Services offers the Client the oppertunity to change their choice! Upon verifed request, Dcphosting Services will ERASE EVERYTHING about the Client's first choice and will "pre-install and pre-configure" the second choice package of equal or lesser value within 72 hours. We will do this up to three times. This gives a Client the oppertunity to compare up to 3 packages and settle with the one the find which suits them best. We must remind Client that by using this feature any information they add to a package will be lost when the package is changed. Save a copy of your work. Apply Here

Uptime Guarantee:
Dcphosting Services strives to maintain a 99% website uptime service level. This uptime percentage is a monthly figure, and is is calculated solely by Dcphosting Services monitoring systems or Dcphosting Services authorized/contracted outside monitoring services. If Dcphosting Services fails to meet it's 99% uptime guarantee, and it is not due to one of the exceptions below, credits will be made available to each client, upon request, on a case by case basis. Dcphosting Services does not credit a full month's service for minor downtime. This would not be financially healthy for Dcphosting Services, and in turn would only negatively affect the service level Dcphosting Services provides to you. In extreme circumstances, Dcphosting Services may distribute full month credits, but this is dealt with on a case by case basis. Details on how credit amounts are calculated can be found below.

Exceptions:
Customer shall not receive any credits under this Hosting Agreement in connection with any failure or deficiency of the Dcphosting Services network caused by or associated with:

  • Circumstances beyond reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, "Acts of God" (ie...fire, flood, earthquake, tornado, etc...), strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, failure of third party software or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Service Level Agreement
  • Telco Failure (ie...Verizon™ cutting a fiber line somewhere)
  • Backbone peering point issues (ie...UUnet™ having a router go down in Virginia that wipes out internet service for the entire East Coast)
  • Scheduled maintenance for hardware/software upgrades
  • DNS issues not within the direct control of Dcphosting Services
  • Client's acts or omissions, including without limitation, any negligence, willful misconduct, or use of Dcphosting Services service(s) in breach of Dcphosting Services Conditions of use, by Client or others authorized by Client.

Credits:
Credit requests must be made on the Dcphosting Services web site using our contact form. Each request in connection with website outages/downtime must be received by Dcphosting Services within five days of the occurance. The total amount credited to a Client for Dcphosting Services not meeting our Hosting Agreement will not exceed the service fees paid by Client Dcphosting Services for such services for the period in question. Each validly requested credit will be applied to a Client invoice within 30 days after Dcphosting Services's receipt of such request. Credits are exclusive of any applicable taxes charged to Client or collected by Dcphosting Services. Upon Client's request (in accordance with the procedure set forth below), Dcphosting Services will issue a credit to Client for website outages/downtime occurring during any calendar month that are reported by Client to Dcphosting Services and confirmed by Dcphosting Services's measurement reporting. Such credit will be equal to one MONTH's worth of service.

Account cancellations:
Your account can be cancelled ONLY by submitting the cancellation form. Other methods of cancellation are not valid. Once the form is submitted, the account will be cancelled shortly thereafter.

General:
Dcphosting Services reserves the right to change or modify this Hosting Agreement and will post changes to location currently housing this Hosting Agreement at time of modification, which will be made available to Client. Except as set forth in this Hosting Agreement, Dcphosting Services makes no claims regarding the availability or performance of the Dcphosting Services network or servers. Specific terms/points of this Hosting Agreement may be adjusted on a case by case basis by the specific Service Agreement signed/agreed by client. In case of difference terms/points in Hosting Agreement and Service Agreement, the Service Agreement terms/points prevail over this general Hosting Agreement policy. The Service Agreement signed/agreed by client, is above and beyond this Hosting Agreement, and Service Agreement terms are in affect, including, but not limited to, limitations of liability.
